Notice of Bankruptcy Court Fee Schedule Increases effective November 1, 2011: At the Court Administration and Case Management Committee’s June 2011 meeting, the Committee recommended adjusting miscellaneous fees for inflation (compounded), noting that it had been eight years since they were last adjusted. The recommendations were sent to the Judicial Conference, and, at its September 2011 session, the Judicial Conference approved changes to the miscellaneous fee schedules for the courts of appeal, district courts, bankruptcy courts, the Court of Federal Claims, and the Judicial Panel on Multidistrict Litigation, pursuant to 28 U.S.C. §§ 1913, 1914, 1930, 1926, and 1932, respectively. These changes will become effective November 1, 2011, click here to view the court's notice. The revised schedule of fees is also available on the court’s web site. Click here to view those changes.

ARIZONA BANKRUPTCY LOCAL RULES
The 30-day comment period for proposed General Order 106 has concluded. Over 25 comments were received, and the court is now in the process of reviewing them. The court wishes to thank all those who took the time to review the proposed GO and submit comments.

Proposed Rule Change: The court has posted for a 30-day comment period, a proposed General Order which adopts a change to Local Rule 2003-1. The proposed change would add a new subsection (c) to clarify the district's practice that with the exception of emergencies or unresolvable calendar conflict, counsel of record must appear at 341 Meetings with their clients.Court Adopts Proposed Changes to Model Chapter 13 Plan and Local Rule 2084-4
The court has adopted a Model Chapter 13 Plan, referenced as Local Plan Form 13-2. Local Rules
The Court has adopted changes to its local rules, effective December 1, 2009. Consistent with time deadline changes in the Federal Rules of Bankruptcy Procedure scheduled to go in to effect on December 1, 2009, the court's local rules have been revised. Specifically, five day deadlines become seven days; 10 and 15 day deadlines become 14 days; 20 day deadlines become 21 days; and 25 day deadlines become 28 days. For deadlines in 7 day increments, all reference to "business" or "calendar" days has been revised to reflect a simpler "days are days" approach.Use the links below to view the individual local rules in Web format.

HAMP is a federal program designed to help struggling homeowners stay in their homes by modifying their monthly mortgage payments to make the payments more affordable. Though not all homeowners will qualify for this program, for those who do, HAMP may provide a real opportunity to save their homes. This video provides a basic overview of what HAMP is and how it works, particularly within the bankruptcy context.While this video was prepared primarily for the private chapter 7 and chapter 13 trustees who handle the day-to-day administration of bankruptcy cases, anyone interested in gaining a general understanding of HAMP will find it helpful.

MEANS TESTING
Most individual debtors filing for bankruptcy relief are required to complete either Official Bankruptcy Form 22A or 22C (Statement of Current Monthly Income and calculations). Bankruptcy Form 22A is the form chapter 7 debtors will complete for “means testing” purposes; Form 22C is the form chapter 13 debtors will complete. [The Official Bankruptcy Forms can be found on the Administrative Office of the U.S. Courts Web site.]
Means Testing
A debtor must enter income and expense information onto the appropriate form (i.e., Form 22A or Form 22C)and then make calculations using the information entered. Some of the information needed to complete these forms, such as a debtor's current monthly income, comes from the debtor's own personal records. However, other information needed to complete the forms comes from the Census Bureau and the Internal Revenue Service (IRS). This Web site reproduces the Census Bureau and IRS Data necessary to complete Bankruptcy Forms 22A and 22C. The source data reproduced here is also available directly from the IRS and Census Bureau using the links at the bottom of this page.
For questions related to this data, e-mail: ust.mt.help@usdoj.gov. For general assistance in filing for bankruptcy relief, the clerk of your local bankruptcy court or your local state Bar Association may have information regarding individuals or organizations offering bankruptcy related services, including on a reduced fee or pro bono basis.
